    Terms of Service

    1. Acceptance of Terms

    By accessing or using Kaisah ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Kaisah.

    2. Description of Service

    Kaisah provides a platform for businesses to collect customer feedback and prepare review drafts for Google. The Service includes QR code generation, customizable review questions, review draft generation, analytics dashboards, and related tools. The Service is available via web browser at kaisah.com.

    Compliance posture. Kaisah is designed to comply with Google's review content policies and the United States Federal Trade Commission (FTC) Final Rule on Consumer Reviews and Testimonials. Specifically, every customer who completes the review flow is offered the option to post their review to Google, regardless of the sentiment or rating of their experience. Customers who wish to share feedback privately with the business so the business can follow up can do so in addition to, never instead of, the Google review option. The Service does not selectively suppress, filter, or gate access to public review platforms based on customer sentiment or rating.

    3. User Accounts

    You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when creating an account. You must notify us immediately of any unauthorized use of your account.

    4. Plans and Billing

    Kaisah offers a Free plan and paid plans (Essentials and Unlimited). The Free plan includes a set number of reviews each month at no cost and no credit card, as described on our Pricing page. Paid plans are billed through Razorpay on a recurring basis. By subscribing, you authorize recurring charges to your chosen payment method.

    You may choose monthly or annual billing for paid plans. Annual billing carries a prepay discount as shown on our Pricing page. Custom enterprise or agency plans for businesses managing multiple locations are available subject to a separate written agreement.

    Customers in India are billed in Indian Rupees (INR). Customers outside India are billed in US Dollars (USD). Any applicable taxes, including Goods and Services Tax (GST) where required by law, will be shown separately on each invoice. If you are a registered business in India, you may provide your GSTIN at the time of purchase for it to appear on the tax invoice.

    Refund policy: we offer a full refund within 14 days of your first paid charge, no questions asked. Email us at the address listed on the contact page within 14 days and we will refund the full amount you paid. After the 14-day window, plans are non-refundable, but you may cancel anytime and your paid features will remain active until the end of the billing period you have already paid for. Custom enterprise or agency plans may have additional refund and cancellation terms as set out in the separate agreement.

    5. Acceptable Use

    You agree not to:

    • Use the Service to generate fake or misleading reviews
    • Incentivize customers to leave only positive reviews
    • Violate Google's review policies or any applicable laws
    • Attempt to circumvent any security features of the Service
    • Use the Service to harass, abuse, or harm others
    • Reverse-engineer, decompile, or disassemble any part of the Service
    • Use automated scripts, bots, or scrapers to access the Service
    • Resell or sublicense the Service without written authorization

    6. Review Generation

    The review drafts are suggestions based on customer feedback. Customers are free to modify, edit, or choose not to post them. We do not guarantee that any review content will be accepted by Google or any other platform. You acknowledge that review content is ultimately published by your customers, not by Kaisah.

    7. Intellectual Property

    The Service and its original content, features, and functionality are owned by Kaisah and are protected by intellectual property laws. Your business data and customer reviews remain your property. By using the Service, you grant Kaisah a limited license to process your data solely for providing the Service.

    8. Service Availability

    We strive to maintain high availability for the Service. However, we do not guarantee uninterrupted availability. Planned maintenance windows will be communicated in advance when possible. We are not liable for downtime caused by factors outside our control, including but not limited to third-party service outages (Supabase, Google, Razorpay), internet connectivity issues, or force majeure events.

    9. Data Processing

    When you use Kaisah to collect customer feedback, you act as the data controller and Kaisah acts as the data processor. You are responsible for ensuring you have appropriate consent from your customers to collect their feedback. Kaisah processes customer data solely to provide the Service as described in these Terms and our Privacy Policy.

    We process data in accordance with applicable data protection laws. Customer review responses do not contain personally identifiable information and are stored anonymously.

    10. Termination

    We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without prior notice. You may delete your account at any time through the Settings page. Upon termination, your data will be handled as described in our Privacy Policy.

    11. Disclaimer of Warranties

    The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that the results obtained from the Service will be accurate or reliable.

    12. Limitation of Liability

    To the maximum extent permitted by applicable law, Kaisah and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

    In no event shall Kaisah's total aggregate liability exceed the amount you paid to Kaisah in the twelve (12) months preceding the claim, or INR 5,000 (approximately USD 60), whichever is greater.

    13. Indemnification

    You agree to indemnify and hold harmless Kaisah from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

    14. Dispute Resolution

    Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

    The arbitration shall be conducted in Surat, Gujarat, India, in English. The arbitrator's decision shall be final and binding on both parties.

    15. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.

    16. Changes to Terms

    We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

    17. Severability

    If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
